Terms and Conditions for Online Booking of Accommodation Services


1. GENERAL PROVISIONS

The purpose of these Terms and Conditions is to define the terms and conditions for booking accommodation online (hereinafter: the Services) through the website available at https://noclegiskrzetuski.pl.
The Terms and Conditions are available on the Property’s website. At the Guest’s request, the Service Provider will send a copy of the Terms and Conditions free of charge to the email address provided by the Guest.


2. DEFINITIONS

The following terms used in the Terms and Conditions shall have the meanings below:

  • Apartment – a room in the Property presented on the Website and designated by the Service Provider for short-term rental.
  • Guest – a natural person over 18 years old with full legal capacity, a legal entity, or an organizational unit without legal personality but with legal capacity under statutory law, who uses the Service.
  • Property – the facility “Skrzetuski noclegi” located at Kleeberga 15, 21-411 Wojcieszków.
  • Terms and Conditions – this document.
  • Agreement – an electronic agreement for the provision of the Apartment booking service as specified in these Terms and Conditions.
  • Service – the electronic service provided by the Service Provider to the Guest, consisting of booking a selected Apartment and making a payment for the booking via the Website.

  • Website – the Property’s website https://noclegiskrzetuski.pl through which the Service is provided.
  • Conditions – the “Short-Term Rental Terms” document available on the Website.

3. TYPE AND SCOPE OF THE SERVICE

The Service Provider offers the Service electronically.
The conditions for using the Service are:

  • Reading and accepting the Terms and Conditions by checking the appropriate boxes in the booking form available on the Website.
  • Declaring the payment method for the Service and opting for a VAT invoice if desired by checking the appropriate boxes on the booking form.

To use the Service, an internet connection, an email account, and a web browser are required.

The Service Provider informs that using the Website, including making a booking, may involve internet connection costs (data transmission fees) according to the Guest’s service provider’s tariff plan.


4. BOOKING

The process for booking an Apartment by the Guest includes the following steps:

  1. Selecting an Apartment based on information provided on the Website, including availability, type, and price.
  2. Providing required data through the booking form on the Website’s “Book” tab, including name, email address, and phone number.
  3. Clicking the “Book with Payment Obligation” button.
  4. Making the payment using the available methods indicated on the Website.

Failure to confirm reading and accepting the Terms and Conditions and Conditions will prevent the booking process from continuing.

The Guest must pay 100% of the booking fee before arrival. Unpaid bookings will be automatically canceled on the same day. After payment, the Guest will receive a booking confirmation and details via the email provided. Additionally, the entry code for the Property and the Apartment will be sent to the provided mobile number. The booking Agreement is considered concluded once the confirmation is sent.

Guests can use the Property’s parking for free.
Smoking is prohibited on the Property’s premises.

Booking changes are allowed only with the Service Provider’s consent. To request a change, the Guest should email kontakt@milten.pl or call 601 72 52 33. Changes depend on Apartment availability. If the change results in additional costs due to a higher-standard Apartment, the Guest must pay the difference within 3 days. Overpayments will be refunded within the same timeframe.

Booking cancellations:

  • Cancellation up to 14 days before the rental date – 50% refund.
  • Cancellation within 7 days of the rental date – no refund.

Refunds will be made to the account from which the payment was made.

The prices listed on the Website are gross prices and include only the Services specified.

The Service Provider integrates with external payment operators such as PayU. The Service Provider is not responsible for malfunctions or disputes between the Guest and these operators.

The Guest has no right to withdraw from the Agreement under Article 38(1)(12) of the Consumer Rights Act.


5. SERVICE PROVIDER’S OBLIGATIONS

The Service Provider must provide the Service in accordance with these Terms and Conditions.
The Service Provider is obligated to promptly fix any faults that hinder or prevent the Service.


6. GUEST’S OBLIGATIONS

In using the Service, the Guest must:

  • Comply with the Terms and Conditions and Conditions.
  • Adhere to applicable laws, good practices, and internet usage rules.
  • Provide accurate data in the registration form.
  • Promptly inform the Service Provider of any security breaches or service issues.
  • Refrain from activities that threaten the system’s security.
  • Avoid using the system for illegal activities or infringing on third-party rights.

7. LIABILITY

Neither party is liable for damages resulting from force majeure, including natural disasters, epidemics, social unrest, or government actions.

The Service Provider is not responsible for temporary interruptions due to maintenance or third-party actions (e.g., network providers). The Service Provider will endeavor to restore service promptly.


8. COMPLAINTS

Guests may file complaints regarding the Service within 14 calendar days of an issue. Complaints should be sent to kontakt@milten.pl or by post to the Service Provider’s address.
Complaints should include the booking number, name, issue description, and contact details.

The Service Provider will respond within 14 days.


9. PERSONAL DATA

Details on data protection are available in the Privacy Policy on the Website.


10. FINAL PROVISIONS

The Terms and Conditions take effect upon publication on the Website. The Service Provider may amend the Terms and Conditions for valid reasons (legal compliance, new services, technical changes). Changes do not affect bookings made before the amendments.

Any disputes will be resolved through negotiation, mediation, or by a court competent for the Service Provider.

Guests can access out-of-court dispute resolution through consumer protection bodies and platforms like ODR.

Polish law applies.
